E ali već je pre par godina postojao pokušaj da se svaka fotografija uz tekst tretira kao "osnovna vest" koja ne podleže autorskim pravima. Prvo koriste mišljenje stručnjaka po kome objavljivanje svake fotke vredi hiljadu evra, što je jedno pedeset puta veće od tržišne cene. A to važi i za potpune krševe, umetnička dela i novinsku ekskluzivu. Onda hoće da donesu zakon po kom svaka slika može da se ne tretira kao autorsko delo. Još veći debilizam. Ono što se kaže, dve pogrešne stvari ne čine jednu dobru. Potpuno je fascinantno da zakone donose ljudi koji nemaju pojma niti o pravu, niti o tematici, i pride nisu posvetili nimalo truda da razumeju tematiku. Quote Link to comment

U pravu je verodostojnost saglasnost neceg sa istinitim cinjenicama, dok ovo sto tebe interesuje predstavlja misljenje o sopstvenom zakonu onog ko ga je doneo u pogledu nejasnoca ili praznina. Dakle, suprotno prvom slucaju gde je sve poznato i nema nejasnog. Ovde se pojam autenticnosti vezuje za donosioca. Dakle slobodno mozes u tom smeru da napravis formulaciju " misljenje donosioca zakona koji je ovlascen da ga da radi tumacenja.." jbg ne znam ni ja jezik verovatno moze u tri reci a pokusavam da ti priblizim Quote Link to comment

To: Delegation of the European Commission in Republic of Serbia It has come to my attention that, on January 22, the Parliament of the Republic of Serbia will discuss the Authentic Interpretation of the Copyright and Related Right Law („Zakon o autorskim i srodnim pravima“). This act will abolish the provisions of the Copyright Law concerning media photography, to the extent that all media photography published in electronic media will be regarded as public domain, and copyright infringements will not be liable for civil lawsuits, as photography will not be regarded as an work of authorship. „Pursuant to the above, any routinely made photo which appears and is delivered in electronic form, regardless of whether it is an original intellectual creation, cannot be regarded as a work of authorship in Article 2. 2, item 9) of the Copyright and Related Rights, and enjoy copyright protection “. This act of interpretation further clarifies the „routinely made photo“ as any news photo made for the electronic media use, as well as photographs shared by social media. In my opinion, this drastic step is in sharp contrast with the provisions of the Berne Convention, which is ratified by Serbia and conditions of the Convention are mandatory for all candidate countries. I urge you to exercise your influence and prevent this serious breach of EU and WTO provisions that constitute a dire threat to Serbian media as well as regular citizens whose works of photography are now automatically protected as a work of autorship, in accordance with the Berne Convention.
